These Terms of Use (the “Terms”) reflect the terms and conditions that you agree to when you create, maintain, and use an account with Mavericks Barbershop Inc. and/or Mavericks Barbershop La Jolla, Inc. (hereinafter referred to as the “Company”). Subscribing members of the Company (hereinafter “you” or “Member”) are strongly encouraged to read these Terms. The Company reserves the right to modify these Terms at any time and will notify you if such changes occur.

Subscription Agreement

Pursuant to the Company’s marketing materials, this subscription grants you limited rights to discounted grooming services and other perks provided by the Company (the “Services”). By entering into this Agreement, you agree that the Services provided in consideration for the monthly fee (the “Fee”) represent good and valuable consideration. The Services may include:

  • VIP Barber Cut – $25 per month (regular price $35)
  • VIP Full Cut – $45 per month (regular price $55)
  • Offers a $10 discount on the regular price
  • 1 x standard haircut per calendar month
  • $5 off on additional services (beard trims, hair washes, straight razor shaves)
  • Unused monthly services or credits will not roll over to the following month.

The Services may be amended at the discretion of the Company.

Authorization to Charge Card

By signing this Agreement, you authorize the Company to charge the credit or debit card provided to the Company for the monthly Fee. Even if you do not use your credit in a given month, the Fee will still be charged to maintain your account and hold an appointment slot for your use.

Term & Termination

This Agreement operates on a month-to-month basis and will automatically renew until terminated by you. To terminate, you may notify us via email, phone, or in person at the front desk. Termination will take effect 30 days after your notification and may overlap with the following month, during which charges may still apply.

Health & Safety

The Company strives to provide a clean and safe environment for all patrons. You agree to disclose any allergies, sensitivities, or pre-existing conditions that may affect your services. The Company is not liable for any reactions or adverse effects if you fail to disclose relevant information.

Minimum Age

By entering into this Agreement, you affirm that you are at least 18 years old and legally capable of entering into contracts. If the Company discovers that this representation is false, the Agreement may be terminated immediately without recourse.

Privacy

The Company complies with applicable privacy laws, including the California Consumer Privacy Act. Your personal information will not be sold or shared with third parties unrelated to the Company’s business. If you have questions about your privacy rights, please contact the Company.

Arbitration Clause

All disputes arising under this Agreement shall be resolved through binding arbitration under the rules of JAMS. The arbitration will be held in the County of San Diego, California, before a single arbitrator. Each party will bear its own legal fees, and the prevailing party may be awarded reasonable costs.

General Release

By utilizing the Company’s services, you release the Company and its affiliates from all claims related to personal injury, property damage, or other liabilities. You expressly waive your rights under California Civil Code Section 1542, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him, must have materially affected his settlement with the debtor.”

Waiver of Liability

You agree to hold harmless and indemnify the Company, including its owners and affiliates, from all claims or damages arising from your use of the Company’s services. This includes, but is not limited to, personal injury, property damage, or economic loss.

Venue

This Agreement is governed by the laws of the State of California, and any disputes will be resolved in San Diego County.

Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions will remain in effect.

Modification of Terms

The Company reserves the right to update these Terms. Members will be notified of changes via email. Continued use of the Company’s services constitutes acceptance of the updated Terms.

Entire Agreement

These Terms constitute the entire agreement between you and the Company and supersede all prior representations, agreements, or understandings.
